Supreme Court docket says wrongful loss of life lawsuit in opposition to Dallas officers can go ahead

DALLAS - The excessive courtroom will allow a wrongful dying lawsuit to proceed against the town of Dallas and 4 police officers.

The household of a man who died in police custody in 2016 sued.

Tony Timpa referred to as police for help as he had a drug and psychological health disaster.

The town fought against releasing body camera video and whit it did come out it was obvious why. It showed the officers mocking the dying man.

One had his knee on Timpa’s again and neck for nearly quarter-hour and the medical examiner said that contributed to his loss of life.

Town of Dallas argued the officers are legally shielded from lawsuits.

The Supreme Court upheld a federal appeals court docket’s ruling that may permit the case to proceed.

"The choice means that the case can proceed to trial and that there will probably be no more delays from any appellate courtroom. Also, the choice implies that the Fifth Circuit did it proper that their ruling relating to lethal force will be the legislation of the land no less than in Mississippi, Texas and Louisiana for as long as we know," stated Geoff Henley, an attorney for Timpa’s family.

Those are the states covered by the Fifth Circuit Court of Appeals ruling permitting the suit to continue.

Three years in the past, the Dallas district legal professional dropped criminal expenses in opposition to three of the officers.
